Rules & Regulations
1. The Cosmoprof North America Awards and Cosmopack North America Awards (“Cosmoprof Awards”) are only open to exhibitors attending Cosmoprof North America Las Vegas 2024 or Cosmopack at Cosmoprof North America Las Vegas 2024 in Las Vegas, Nevada from July 23-25, 2024 (the “Show”).
2. Cosmoprof Awards is sponsored by USA Beauty LLC dba Cosmoprof North America (“Organizer”). BEAUTYSTREAMS, a beauty trends forecasting agency, will assist Organizer in the review and selection of certain products from established categories to win the prizes described herein. Employees (and their immediate families and households) of Organizer, BEAUTYSTREAMS, and their parent companies, subsidiaries, affiliates, dealers, and advertising and promotion agencies are not eligible to enter.
3. For each of the six (6) categories (“Award Categories”) below, BEAUTYSTREAMS will select four (4) finalists in consultation with Organizer. From that pool, one (1) winner for each Award Category will be selected by a panel of judges.
- For Cosmoprof Exhibitors: (i) Makeup & Nail Products
(ii) Green & Organic
(iii) Skin & Body Care Products
(iv) Hair Products
- For Cosmopack Exhibitors: (i) Formulation
(ii) Packaging: Design & Materials
There will be twenty-four (24) shortlisted finalists (“Finalists”), and six (6) winners (“Winners”) total. The odds of being selected as a Finalist depend on the total number of eligible entries received. The odds of being selected as a Winner of each Award Category is 1 in 4.
4. The entry period for the Cosmoprof Awards begins March 19, 2024 at or around 12:01 AM PST. Applicants can submit a maximum of two (2) products per Award Category. Each applicant must complete and submit an entry form (“Entry Form”) for their product(s) by 11:59 PM PST on May 31, 2024, in order to be considered..
5. To ensure the highest possible score, the Entry Form for each Award Category should be completed in full, including only information that is relevant to the Award Category. A photograph of the product must also be included with the Entry Form. Entry Forms must be submitted in English only.
6. Organizer and BEAUTYSTREAMS reserves the right, after consultation with the applicant, to amend Section 1, “Award Category,” of applicant’s Entry Form, as appropriate.
7. On or about June 21, 2024, Organizer and BEAUTYSTREAMS will announce which applicants have been shortlisted as a Finalist in the Cosmoprof Awards on the Cosmoprof North America website. An entry to an Award Category cannot be withdrawn from the judging process once the applicant has been short-listed and announced as a Finalist.
8. Finalists are required (as the case may be) to provide additional product information and copies of supporting documents upon the request of Organizer.
9. Once shortlisted, Finalists are required to submit, at a minimum, five (5) full-sized products and any additional information requested by Organizer no later than July 12, 2024, according to Organizer’s further instructions. Finalists are required to cover any shipping/courier costs and duties related to the product sample submission. Finalists acknowledge that they ship their products at their own risk and are fully responsible for any theft or damage that occurs during transport. Organizer declines any and all liability in case of deterioration, damage, or alteration of the products during transport to the place of delivery indicated by Organizer or during the unpacking and installation of the products at the Show, including any loss of the products during transport.
10. All information submitted, including products, will not be returned. Organizer is not liable for any costs or liabilities incurred by applicants during any part of the judging process.
11. Entry to the Cosmoprof Awards does not grant an organization or individual any rights to use the name, logo, or images of Organizer, BEAUTYSTREAMS, the Cosmoprof Awards, Cosmoprof North America, Cosmopack North America, or any of its affiliates, without the express written approval of Organizer. Only Finalists will be granted a non-exclusive, royalty-free license to use the Cosmoprof Awards logo in compliance with the guidelines stipulated by Organizer.
12. Organizer reserves the right, at its sole discretion, to withdraw any applicants from the judging process at any time, if their entries are deemed inappropriate for any reason (including false or inaccurate information declared in the Entry Form). Organizer also reserves the right, at its sole and unchallengeable discretion, to ban with immediate effect from the Cosmoprof Awards, any applicant in case of
- inaccurate completion of the Entry Form for whatever reason (including in case of provision of false or inaccurate information);
- ascertained or suspected infringement of third-party rights, including intellectual property rights and copyrights;
- disparaging behavior or corruption towards the judges of the Cosmoprof Awards and/or Organizer’s or BEAUTYSTREAMS’ personnel; or
- any dispute and/or claim pertaining to the products and/or to the contents presented by applicant to the Cosmoprof Awards. In the event that the infringement and/or illicit behavior of the applicant should result in actions or claims by third parties also involving the Organizer, the applicant in question shall indemnify and hold harmless Released Parties (defined below) from any and all direct or indirect damages, loss, or expense (including disbursements and legal fees) connected with or deriving from the aforementioned breaches or tort of the applicant.
13. The Cosmoprof Awards judging panel, made up of ten (10) retailers, brand executives, designers, research and development experts, as well as B2B and B2C press with relevant expertise and experience in the beauty industry, will consider each Finalist against the Award Category criteria and their own discretion to select the Winners. 14. The Winners of each Award Category will be announced on or around July 23, 2024 during the welcome reception at the Show. The judges’ decisions are final and binding. No discussions or correspondence will be accepted relating to any of their decisions.
15. Finalists will
- have their product featured on a dedicated website offering visibility of their product for one (1) year
- have their product featured in a Cosmoprof Awards themed installation at the Show
- have their product featured on the BEAUTYSTREAMS premium product bank platform at beautystreams.com
- receive an official Cosmoprof Awards Seal to be used for promotional campaigns
- receive a dedicated marketing campaign and press release prior to the Show
- have their product featured in a dedicated Cosmoprof Awards marketing campaign and press release around the time of the Show
Additionally, Winners will receive
- a designer Award developed in collaboration with Maragoni Institute
- an opportunity to showcase their product during Cosmoprof Worldwide Bologna 2024
Approximate retail value (“ARV”) of the prize package is $4,000 USD. Finalists and Winners will comply with all guidelines, instructions, and directives issued by Organizer in relation to the prize package. Finalists and Winners may not substitute, assign, or transfer any element of the prize package, but Organizer reserves the right, at its sole discretion, to substitute a prize of comparable or greater value. Prizes are awarded ‘as is’ with no warranty or guarantee, express or implied. Each Finalist and Winner may be required to sign and return an Affidavit of Eligibility and Liability/Publicity Release, provide valid identification, and any relevant tax forms upon request, or any portion of the prize package may be forfeited. All federal, state, and local taxes, if any, and all other costs and expenses associated with prize acceptance and use not specified herein as being provided are the sole responsibility of Finalists and Winners. All prize details are at Organizer’s sole discretion.
16. By submitting the designs, images, and products to Organizer, each applicant agrees and declares that they are authorized to and hereby grant Organizer and its licensees and assignees, a royalty-free, non-exclusive, worldwide, perpetual license to exercise all rights in the designs, images, and product samples and all material provided by the applicant to Organizer at any time (including, but not limited to, the right to use, to copy, edit and/or modify, publicly display, publicly perform, broadcast, and republish in any/all media).
17. Each applicant grants Organizer and its affiliates the right to use their name, likeness, biographical information and/or photograph, both online and in print, for the purposes of advertising, publicity, and promotional materials, without further consent required or additional compensation provided, except to the extent prohibited by law.
18. Each applicant should note that the product identified on their Entry Form may be publicly disclosed. If deemed necessary or appropriate, the applicant should file a patent application before submission. Nevertheless, subject to institutional policy, every applicant shall be solely responsible for the pursuit of any form of intellectual property protection for their submission. Organizer is not liable for infringement, misuse, or abuse of any design as a result of entry the Cosmoprof Awards, or as a result of any subsequent promotion and publicity.
19. Organizer is not responsible for the proof of originality of the entries, nor is liable for protection of design copyright. Each applicant (i) retains sole copyright to their entry, (ii) is responsible for providing proof of originality of their entry, and (iii) is solely liable for their design(s), samples, and entry.
20. In the event of any dispute, Organizer reserves the right to disqualify any entry and/or retract any prize or award from the applicant. All decisions made by Organizer are final and binding in all aspects relating to the Cosmoprof Awards.
21. Each applicant agrees they will abide by and be bound by these Rules & Regulations of the Cosmoprof Awards. Any applicant who, in the opinion of Organizer, is perceived to have harassed or bribed any member of the judging panel or the Cosmoprof Awards team, will have their entries disqualified. By entering the Cosmoprof Awards, each applicant warrants that: (a) all details provided with the Entry Form are true and accurate; (b) they have all necessary rights and licenses to grant the rights set out in these Rules & Regulations; (c) they are the copyright owner of the submitted photograph and/or images as its author (and any individual whose image is featured in the photograph has given consent for the use of his/her image); (d) they are the copyright owner and owner of all intellectual property rights in all logos and/or names of products submitted to the Cosmoprof Awards and, if selected, featured at the Show; (d) the exercise of the rights granted to Organizer in these Rules & Regulations will not infringe the rights of any third parties.
22. By entering, applicants acknowledge and agree that Organizer makes no representation or warranty as to any business outcome resulting from attendance at the Show, participation in the Cosmoprof Awards, or from any prize component. Finalists and Winners may be required, at Organizer’s sole discretion, to sign a contract as a condition of receipt of any portion of the prize package. Each applicant fully releases Organizer, its affiliates, BEAUTYSTREAMS, and its and their respective directors, officers, employees, agents, as well as the judges of the Cosmoprof Awards and all others associated with the development and execution of the Cosmoprof Awards (collectively, “Released Parties”) from any liability, loss, damage, or injury resulting from participating in the Cosmoprof Awards (including attending and/or exhibiting at the Show), or awarding, receipt, possession, use and/or misuse of any prize awarded herein. Released Parties are not responsible or liable for purchases or subsequent usage of any portion or component of the prize package.
23. Released Parties assume no responsibility for any incorrect or inaccurate information, whether caused by website users, or by any of the equipment or programming associated with or used in the Cosmoprof Awards. Released Parties are not responsible for (i) any error, omission, interruption, deletion, defect, or delay in operations/transmission or communications-line failure, or (ii) theft of, destruction of, unauthorized access to, or alteration of Entry Forms. Released Parties are not responsible for any problems or technical malfunction of any computer online systems, servers, or providers, and computer equipment or software. Released Parties are not responsible for any failure of email or entry on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to any applicant or any person’s computer related to or resulting from participating in the Cosmoprof Awards or downloading or uploading materials to/from the websites. If the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, hacking, unauthorized intervention, fraud, technical failures or any other causes beyond the reasonably control of Organizer which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Cosmoprof Awards, Organizer reserves the right, at its sole discretion, to disqualify any individual who tampers with the entry process and to cancel, terminate, modify, or suspend the Cosmoprof Awards and award the prizes from among all Entry Forms received prior to the time of termination.
24. Each applicant will fully indemnify Released Parties against any past, present or future loss, liability, damage, cost, or expense whatsoever resulting from or related to any Cosmoprof Awards related activity, including (i) participation in the Cosmoprof Awards, (ii) attending the Show, (iii) acceptance, use/misuse of any prize, and (iv) any breach of these warranties or applicable law. Each applicant will fully indemnify Released Parties for any loss, liability, damage, cost or expense in relation to any infringement of third-party intellectual property rights or violation of applicable law.
25. By entering, applicants agree that any personal information provided will be used/store in accordance with Organizer’s Privacy Policy. The Cosmoprof Awards, the Show, and related events, web pages, content and code are the property of Organizer or their licensors. Copying or unauthorized use of any copyrighted materials, trademarks, or any other intellectual property without the express written consent of owner is strictly prohibited. Void where prohibited or restricted.
